Please read the following terms and conditions of sale carefully. Every order is governed exclusively by these terms. Submitting your electronic order form implies that you have read these terms beforehand, and constitutes their full and irrevocable acceptance.

This English text is a courtesy translation. In the event of any discrepancy, the French version prevails.

Preamble

The gojirawine.com site, its source code, texts, graphic design and other technical features are the exclusive property of Roadrunner Records Inc, New York 10019 (Warner Music Group Co.).

Images and information

You may not use images from our site without our express written permission. The buyer acknowledges that the images representing the products shown on gojirawine.com are for information and illustration only, and cannot engage the liability of SCEA Vignobles Landeau in the event of an unintentional error in the information published.

Photographs on the wine data sheets are not contractual. Only the vintage stated in the text of the sheets corresponds to the order.

These terms may be amended; the applicable terms are those in force on the site on the date your order is placed.

Article 1: Acceptance of these terms

The purpose of these terms and conditions of sale is to define the rights and obligations of the parties in the context of the distance selling of products offered on gojirawine.com.

By ticking the box "I have read and accept the terms and conditions of sale" before confirming the order, the customer automatically and expressly accepts these terms without restriction or reservation, to the exclusion of any other document such as a leaflet or catalogue issued by the seller, whose value is indicative only.

The customer declares that they are at least eighteen (18) years old and have the legal capacity to place an order on gojirawine.com. Pursuant to article L. 3342-1 of the French Public Health Code, minors under the age of eighteen (18) are not permitted to place orders on the site. If you are under eighteen (18), you must leave the site immediately.

Article 2: Order confirmation

An order placed by the customer is deemed accepted only once confirmed by SCEA Vignobles Landeau.

The customer orders directly on gojirawine.com. To buy one or more items, they follow these steps:

• choice of items and adding to the basket;
• confirmation of the basket contents;
• identification and entry of the delivery address;
• choice of delivery method;
• choice of payment method;
• reading and acceptance of the terms and conditions of sale;
• confirmation of payment.

The customer will receive an order confirmation by email setting out every component of the purchase: description of the products ordered, price, shipping costs.

SCEA Vignobles Landeau reserves the right to refuse an order for any reason. A refusal will be notified by email. The customer may cancel an order only on the express condition that payment has not been collected.

Article 3: Duration of the offer

Offers on the site are subject to available stock. The Liquid Fire cuvées are released in numbered runs: once a run is out, it does not come back.

Article 4: Prices, shipping costs, invoice

Prices are expressed in euros, inclusive of all taxes, VAT included at the rate applicable on the day of the order. Any change to that rate will be reflected in the sale price of the products.

SCEA Vignobles Landeau reserves the right to change its prices at any time, it being understood that the price shown in the catalogue on the day of the order is the only one applicable to the customer. The price guaranteed to the customer is the one displayed on the site at the time of purchase; the amount displayed is firm and final. It does not include contributions to delivery costs, which are invoiced in addition and confirmed in the order confirmation, nor sundry taxes, in particular customs charges.

Transport costs are a flat rate per order, depending on the delivery country and on the number of 75 cl bottles and magnums ordered, each family being shipped in its own packaging. An order holding both bottles and magnums adds up the two rates. The current grid is published on the site's "Ordering and shipping" page and shown again before the order is confirmed.

• transport costs are free for 36 bottles of 75 cl;
• to the United Kingdom, customs duties and charges are added, at €20 per order;
• to Switzerland, customs duties and charges are added, at €25 per order plus 17% of the wine amount;
• those customs duties and charges remain due when transport costs are free.

A shipped order may not exceed 36 bottles of 75 cl; beyond that, please write to us for a freight quotation. Signed magnums are limited to two per customer across all orders, the customer being identified by their email address.

The contents of a basket are held for the customer for twenty minutes from its last change; after that, the products go back on sale.

Article 5: Payment

The amount of your purchases on gojirawine.com is the one shown when your order is confirmed. You warrant to SCEA Vignobles Landeau that you hold the authorisations required to use the payment method chosen when confirming the order form. The customer undertakes to pay the price of the products ordered, including taxes and transport.

Payment is made online, by bank card, through the PayPlug secure payment solution. It is the only payment method offered on the site.

Payment is debited when the order is confirmed. Your card details are entered directly on PayPlug's secure interface and neither pass through nor are stored on gojirawine.com servers: at no point does SCEA Vignobles Landeau have knowledge of your card number.

All data relating to the payment of your orders is encrypted so that the information you provide is protected in transit. PayPlug is a payment institution authorised by the French prudential supervision and resolution authority (ACPR) and certified PCI DSS. Card payments are subject to strong customer authentication in accordance with the second European Payment Services Directive (PSD2).

Article 6: Non-payment and retention of title

The products ordered remain the property of SCEA Vignobles Landeau until their price has been paid in full, in accordance with French law no. 80-335 of 12 May 1980.

SCEA Vignobles Landeau reserves the right to reclaim the products ordered in the event of non-payment. In that case, and on simple request, the customer undertakes to return any unpaid product, all costs borne by the customer.

Article 7: Fulfilment of the order

The order will be fulfilled within the times stated on the site and in the order confirmation, and in any event no later than seven days after the order is confirmed. Products are deliverable subject to available stock and are shipped in the order in which orders arrive.

In the event of a stock shortage, SCEA Vignobles Landeau will offer a refund, by bank transfer, of the product concerned.

Article 8: Delivery

Delivery of the products takes effect once SCEA Vignobles Landeau has recorded the customer's payment.

To date, our offers of products, services and deliveries are valid in metropolitan France, as well as in the following European countries: Belgium, Luxembourg, the Netherlands, Germany, the United Kingdom, Ireland, Denmark, Sweden, Finland, Austria, Italy, Greece, Spain, Portugal, Poland, Czechia, Slovakia, Hungary, Slovenia, Croatia, Romania, Bulgaria, Estonia, Latvia, Lithuania and Switzerland.

Orders are prepared in order of arrival, as fast as we can. Transit starts when the parcel is handed to the carrier and depends on the destination: 2 to 3 working days in metropolitan France, 4 to 10 working days in the other countries we deliver to. The times stated on the site are purely indicative: no compensation may be claimed for a delivery time that is not met.

The delivery note provided by the carrier must be dated and signed by the customer on delivery of the product. That dated and signed note constitutes proof of transport and delivery.

Any claim regarding the condition of the parcel must be recorded immediately on the receipt note by the customer. The customer must inform SCEA Vignobles Landeau of the incident by email, and may in that case obtain a replacement if necessary.

Article 9: Right of withdrawal

In accordance with articles L. 221-18 et seq. of the French Consumer Code, a consumer customer has fourteen (14) days to exercise their right of withdrawal, without having to give reasons or bear any costs other than those set out below.

The period runs from the day on which the customer, or a third party designated by them, takes physical possession of the last product in the order. Where that period ends on a Saturday, Sunday or public holiday, it is extended to the next working day.

To exercise this right, the customer notifies their decision by an unambiguous statement, sent by email or by post to SCEA Vignobles Landeau, 40 rue Stephen Couperie, 33440 Saint Vincent de Paul, France. They may use the model form reproduced below, though they are not obliged to. To meet the deadline, it is sufficient that the notification is sent before the fourteen days expire.

The customer returns the products no later than fourteen days after notifying their decision. The direct cost of returning the goods is borne by the customer. Bottles must be returned in their original condition, unopened and complete; the customer may be held liable for any diminished value resulting from handling other than what is necessary to establish the nature and characteristics of the products.

SCEA Vignobles Landeau refunds the sums paid, less customs charges (paid beforehand by SCEA Vignobles Landeau on the customer's behalf), no later than fourteen days from recovery of the products. The refund is made by bank transfer, at no cost to the customer.

Excessive alcohol consumption is harmful to health. Drink in moderation. The sale of alcohol to persons under 18 is prohibited.
